Topic: How to Maximize Your Chances of Winning on Appeal.

In talking to a client about filing an appeal there is no getting around the daunting prospect of dealing with a system that is intended to favor affirming trial court decisions. There are some things you can do to improve your position, and in this program I will look at five areas, appealability, the record, standards of review, briefing and oral argument, where your decisions and tactics can make a difference.


About the Presenter

Brian C. Unitt is a certified specialist in appellate law. He earned a BA in History and Political Science from U.C. Riverside in 1980, and a JD from the U.C. Davis School of Law in 1983.

He is now a sole practitioner, dividing his time between Riverside and Santa Cruz, but was previously a shareholder and managing partner of the firm of Holstein, Taylor and Unitt from 1985 through June 2021.

Brian has presented at continuing education seminars on appellate practice, ethics, and elimination of bias, and has written articles for the Riverside Lawyer magazine. He is honored to have received the 2006 San Bernardino County Bar Association Florentino Garza Fortitude Award, the 2018 St., Thomas More Award, the 2019 Terry D. Bridges Award from the Leo A. Degan Inn of Court, and the 2022 Appellate Attorney of the Year Award from the Riverside County Bar Association.

He has been a member of the Santa Cruz County Bar since 2021. He is a 40 year member of the Riverside County Bar Association, is a past member of its board of directors, a past chair of its appellate section, and served from 2011 through 2021 as chair of the steering committee for Project Graduate, a program that provided educational mentors to foster youth to help them graduate high school with a plan for their future.
