“850 Petitions”

850 Petitions are a powerful tool for the probate practitioner, but there
are specific requirements that practitioners should know when filing.
There are some ways to use an 850 Petition that are underutilized, in
addition to a Heggstad/Ukkestad Petition. Our speakers, attorneys Lisa
Frisella and Kim Neilson of Frisella Neilson, will discuss
the 850 Petition as an affirmative petition, from the perspective of the
Trustee’s duty to defend, and opposing an 850 Petition, as well as
potential recovery under section 859.
